Andy – An insurrection is an attempt to change the legitimate government by threat or force. They went to DC to “stop the steal”, i.e. to prevent Biden from being certified as the winner so that Trump might continue as president. They were chanting “Hang Mike Pence” and calling for the death of Nancy Pelosi. Numerous people brought various kinds of weapons, including Stewart Rhodes, of Oath Keepers, who was convicted for was bringing in a load of guns. He did not bring them from his hotel room to the capital because he said he was waiting for an order from Trump. He is known to have had a phone call with someone in the White House on that day – not Trump, but someone with immediate access to him. Other people were arrested with rifles and something described as being similar to molotov coctails in their vehicles which were parked nearby. Other people were arrested for using flag poles as weapons, some of which had pre-sharpened ends, which indicates premeditation. Someone else was arrested with a flag wrapped around an ax handle to disguise it.
What else do you need to see in order to identify Jan 6 as an actual insurrection attempt? At least some people literally said they were there for that purpose and brought weapons with the intent to accomplish the task. Granted, most people there had no weapons and were just playing the role of useful idiots, giving the perception of large numbers to the smaller number of people who intended to use violence. But, there were a number of people who went there with the intent to use violence to stop the transfer of power and they reportedly had contacts with Trump’s immediate circle of associates.

Donald Trump has appealed a decision from an Illinois state judge who decided he should be removed from that state’s ballot because of the 14th amendment, an ongoing issue for Trump in the courts.
Tracie Porter, the Cook county circuit judge, made the decision on Wednesday, reversing the previous decision by the Illinois state board of elections, which said Trump could stay on the ballot. The order was put on hold pending an appeal from Trump, which came swiftly on Thursday.
The Illinois decision came after the Colorado supreme court ruled similarly, saying Trump couldn’t hold office again because he had participated in an insurrection while an officer of the United States. Another decision in Maine, by the state’s secretary of state, decided to keep Trump off the ballot there as well, though that is now on hold.
The Colorado decision went before the US supreme court in February, which has yet to rule on the case, though the justices expressed a load of skepticism of the claims that Trump shouldn’t be allowed to run again.

They went to DC to stop the steal – who is they? Tens of thousands of people went to DC to peacefully and legally protest the election theft. This is a fact.
We can disagree whether the election was actually stolen. You can’t dispute the fact that the vast majority of those who went to the protest did nothing illegal, and merely exercised their constitutional rights, regardless of how much you agree or disagree with their cause.
It’s also a fact that Trump publicly said protest peacefully and legally. This is on the record. Tens of thousands of people, including me, were there to hear him say it. There’s video and audio recordings. The speech text is published. It’s indisputable.
Likewise, it’s a fact that Trump publicly, on the record, on live TV, called on J6 rioters to cease and desist. I was not a J6 rioter. I was back in my airbnb and watched him say it on TV. But you can’t claim he didn’t say it. He said it.
At most, you can quibble it took him too long. How do you know what else he was doing as President during that time? Maybe the secret service had concerns for the president’s safety? Maybe he had other job responsibilities? At most, you have unverified, unproven, quite possibly biased or even false accounts of what he was doing.

Mea culpa: I was there at Trump’s speech, which was not at the capitol. I had weapons in violation of DC law, but did not carry them to the rally. I didn’t go to the capitol (the vast majority didn’t).
The illegal weapons were in case of widespread chimping or rioting by DC natives and paid provocators. I had no intent of using them to commit any crimes other than violating unconstitutional DC legal edicts, and did not use them at all.
I did have a few legal objects which could be used as weapons at the rally, in case I needed them for self defense against antifa commie scumbags. No such necessity presented itself.

I tend to think that if Rhodes thought it was a realistic probability, he was delusional. The only indisputable fact is that no such order was issued. There’s a whole lot of room between criminal convict and inmate Rhodes claims he believed he might receive orders on the one hand, and President Donald Trump may have been on the verge of issuing such orders on the other.
David Berkowitz may have been hearing orders from his neighbor’s dog Sam. Charles Manson may have thought he had coded instructions in Beatles lyrics. John Hinckley may have thought that Jodie Foster would go out with him if he shot President Reagan. As far as I know those claims don’t make the pooch, the British pop band, or Ms. Foster guilty of any crimes.

How do we know this? What are your sources? How reliable are they?
If they are reliable, who made this claim? Why should we believe him, her, or them?
If we presume the claim is accurate, it doesn’t tell us much. There are usually lots of people milling around anyone at that moment serving as US president. Many of these people take numerous phone calls from a wide variety of people.
Stewart Rhodes is, and was then, a moderately famous guy and relevant to what was happening that day. I’d have probably taken his call that day if I was a journalist, law enforcement officer, had anything to do with presidential protection, etc, etc.
There are several logical leaps between taking someone’s call and being involved with them in a criminal conspiracy. There are more leaps between someone with immediate access to the President taking a call and the President being involved in a criminal conspiracy.
Who took the call? What was the substance of the call? How do we know this even happened? How about facts instead of insinuations?
Various people were arrested with various weapons. Numbers, please. How many people, with how many weapons?
There’s also the fact that, as someone already mentioned, having a weapon and using, or intending to use it, to help overthrow the government are in fact two different things. That’s even true when there is a tiny handful of people in the vicinity who in fact do have weapons for such a purpose (but nothing even remotely approaching a realistic plan for such).
There were a number of people who brought weapons with the intent of preventing the transfer of power. Yes, that’s true. That number, to the best of my knowledge, was in the single or at most double digits.
If you have evidence to the contrary, please do present it. Otherwise, you have something about as realistic as the antifa “autonomous zones” which claimed to have seceded from the federal, state and local jurisdictions they were under several months earlier, and somewhat less destructive of federal and other government property, etc.

The House Select Committee on January 6 made a criminal referral for Trump to be charged with 18 USC 2383, but he hasn’t yet been formally charged with that. The evidence they used for that referral is in their report.
Someone who commits a murder is a murderer in fact, regardless of whether or not they are later convicted. Jefferson Davis was never convicted of anything, either, but no one, including Davis himself, denied that he was barred from holding office even in the absence of a conviction. If you wish to argue, like Richard Winger, that the applicable penalty applies to being prohibited from being sworn in, rather than prohibited from running for office, I can accept that.
While no one has yet been charged with 18 USC 2383 (Insurrection), at least 14 people (9 Oath Keepers, 5 Proud Boys) have been *convicted* of the substantially similar 18 USC 2384 (Seditious Conspiracy). The difference between them is that seditious conspiracy involves plotting the violent overthrow of the government, and requires the state to prove that actions were taken in furtherance of that plot, while insurrection involves the actual act itself. It’s different stages of the exact same crime. The argument that no one has been convicted of insurrection is junk because there have been convictions for seditious conspiracy.
