Colorado Files Brief in Defense of its Ban on Out-of-State Circulators

On April 27, Colorado filed this brief in defense of its ban on out-of-state circulators. It says that the plaintiffs, including Congressman Doug Lamborn, waited too long to file the federal lawsuit against the ban. However, Congressman Lamborn filed his federal case only two days after the Colorado Supreme Court had removed him from the Republican primary ballot.

The state says Lamborn is free to be a write-in candidate in the Republican primary. And the state says it needs a ban on out-of-state circulators because if the state needs to interview out-of-state circulators about their work, it would take too long to get in touch with them.

Filing Closes for June 30 Special U.S. House Election in Texas

Texas holds a special election to fill the vacancy in the U.S. House, 27th district, on Saturday, June 30. Filing closed on August 27. Parties don’t have nominees in Texas special elections, but party labels are on the ballot. Three Republicans, three Democrats, one Libertarian, and two independents paid their filing fees in order to qualify. If no one gets 50%, there will be a runoff later. Oklahoma Legislature Passes Bill Easing Definition of Political Party

On April 26, the Oklahoma House passed SB 350, which eases the definition of “political party.” Existing law requires a party to poll 2.5% for the office at the top of the ballot, every two years. The bill changes that so it is a group that polls 2.5% for any statewide race, at either of the last two elections.

The bill is now through the legislature and goes to the Governor. The House vote was 77-3.

U.S. District Court Sets Hearing for Monday, April 30, in Case Over Out-of-State Circulator Ban

U.S. District Court Judge Philip Brimmer will hear Goodall v Williams, 1:18cv-980, on Monday, April 30, at 9 a.m. This is the case that will determine if Congressman Doug Lamborn can get on the Republican primary ballot so as to run for re-nomination. The issue is the Colorado law banning out-of-stae circulators.

The people who challenged Congressman Lamborn’s petition in state court are seeking to intervene in the case.
