U.S. District Court Dismisses New Mexico Lawsuit on Trump Ballot Access

On January 12, U.S. District Court Judge Matthew L. Garcia, a Biden appointee, dismissed the lawsuit Castro v Toulouse Oliver, 1:23cv-766.  This is one of the lawsuits filed by John Anthony Castro to keep former President Donald Trump off the ballot in various Republican presidential primaries.

U.S. District Court in Florida Upholds Democratic Party’s Right to Decide Which Candidates Can Appear on Presidential Primary Ballot

On December 12, U.S. District Court Judge Allen Winsor, a Trump appointee, refused to disturb the decision of the Florida Democratic Party that only President Joe Biden may run in the party’s presidential primary.  Steinberg v Democratic Party of Florida.

Here is the 10-age order.  It says that the plaintiff, a Florida Democratic voter, does not have standing, and also that the Democratic Party of Florida is not a state actor.  It also suggests he should have sued all 67 county election officials.

Steinberg says he will appeal.
