Scholarly Article Calls for an End to the Challenge System for Petitions

Capital University Law Review, fall 2006, Volume 35, #1, has just published an article by Law Professor Mark R. Brown, calling for an end to the challenge system of checking petitions. The article is titled, “Policing Ballot Access: Lessons from Nader’s 2004 Run for President.” The article is 81 pages long. Capital University is in Columbus, Ohio.

The “challenge system” is not used in most states. Most states provide that elections officials check the validity of petitions, and their decision is final. A minority of states, however, use the “challenge system.” Petitions are deemed to be valid, but any private individual or group is then free to “challenge” the petition and attempt to show that it lacks enough valid signatures. Brown’s article shows the deficiencies of this system. The article is also useful for documenting the history of most of Nader’s 2004 ballot access fights.

  1. Ralph Nader met me in 1987 when I was a traveling scholar at The Catholic University of America, and a campus “activist”. He told me that I should see what kind of sins he was covering up, and that I should not bother with the useless 2 major parties in the US and that I should be independent. I agreed with him on pollution and foreign oil dependency and thought “war is hell”, but like Truman, I always tell the truth, and that “they think it is hell” whoever “they” are.Ralph, Mike Dowd, formerly of Maine and now in Brooklyn, and I all agreed that Hell was a useless concept, and that this might be it. No Heaven, or afterlife, but a suspicion that “we might all be going”. We had a laugh, but weren’t so sure about abortion rights and what “feminism” is or was, and went our separate ways. I would like Ralph and the “Nader raiders” to help me prosecute the paedophiles who molested me in the 70’s and 80’s because the reports I have filed no body cares about or they just covered up as so many civil authorities usually do. Their names are Mrs. Finn, of st. thomas Grade school west Hempstead, John Robinson, Suffolk County,LI,NY and Father Gene of WH who also molested classmate Louis Martino I heard later on from people, and vaguely remember that he said something to me about that when I was working at Friendly’s family Ice Cream Store in the 1980’s in WH. (It is now a kosher chinese take out store across from the P.O.) The ballot access fights and challenge system I am not really familiar with anymore because I am not a lawyer, but have served as officer of the court in civil ceremonies since my father was a village judge, and I worked as a clerk in his firm years ago. I should have won the 1998 4th Federal District NY State US Congress Election on The Right To Life and Republican Party lines, but was only named Nassau County GOP Party Builder, a non-paying postion in the party because chair Mondello of Oyster Bay Cove,LI,NY thought I was gay since I was not married and had no children, and he hates primaries because they might be divisive. Please help me get nominated and elected to The US Presidency on any available party lines 2008 and 2012, as I have fulfilled the constitutional age and residency requirements to assume the powers of the Office of The Presidency of The United States 2008 and 2012, and am presently the Nassau County Executive Chair to the Constitution Party.   2. Sir Daniel M. J. Tobin should be told that this is not the place to ask for help to be nominated for president. This is a non profit site and some nut job at the FEC could take his published response as an in kind contribution and sue Ballot Access News. Thats right, we really don’t have freedom of speech in this country.

    If you are really interested in getting nominated, look at http://www.thirdpartywatch.com/ . Scroll down and on the right hand side there is a list of third parties with links to their web sites. Contact the party and ask how to run for their nomination. Each party will have different rules. Since you don’t care which party noninates you, my guess is that no one will want you because your stand on the issues do not match theirs. Find a party that closely matches your views before wasting your time.
