Law Professor Analysis of the Legal Issues Involving Presidential Electors — 6 Comments

  1. UNEQUAL popular votes per E.C. *Elector* — ANTI-Democracy minority rule math — producing the nonstop HACKS for Prez since 1796.

Major exception for G. Washington in 1788 and 1792– savior of the American Revolution regardless of all the hacks around him in 1775-1783.

    P.R. and nonpartisan App.V.

  2. Prof B very cutely ignores the Art. II, Sec. 1 language —

Art. II, Sec. 1 part –

Each State shall appoint, in such Manner as the Legislature thereof may direct, a Number of Electors, equal to the whole Number of Senators and Representatives to which the State may be entitled in the Congress: but no Senator or Representative, or Person holding an Office of Trust or Profit under the United States, shall be appointed an Elector.

    12th Amdt part

The Electors shall meet in their respective states, and vote by ballot for President and Vice-President, one of whom, at least, shall not be an inhabitant of the same state with themselves; they shall name in their ballots the person voted for as President, and in distinct ballots the person voted for as Vice-President, and they shall make distinct lists of all persons voted for as President, and of all persons voted for as Vice-President, and of the number of votes for each, which lists they shall sign and certify, and transmit sealed to the seat of the government of the United States, directed to the President of the Senate; ***

in such Manner as the Legislature thereof may direct —

Are Prez/VP Electors agents of each sovereign State — under directions according to election results ???

How many States manage to survive having State governors elected by ALL of the Electors-Voters in such States — with various rural, suburban and urban voter groups ???

  3. In CA the “such manner as the Legislature thereof may
direct” was spelled out in CA Elections Code section 13205(b). Yet 57 of CA 58 County ROV’s did not comply
with CA Elections Code section 13205(b). Only ROV La Vine of Sacramento County made an attempt to comply
with that publishing requirement by changing making the
cross (+) in a square to filling in an oval. Therefore we have an “illegal vote” in all of 57 of the 58 counties in California for party presidential and Vice Presidential Electors. Therefore CA Election Code 13200 becomes
effective here. Do not count the vote!
