Don Blankenship Files Lawsuit Against California Independent Presidential Petition Procedure

On July 7, Don Blankenship, presidential nominee of the Constitution Party, filed a federal lawsuit against the California law that requires petitioning candidates for president to get 196,964 signatures during the period mid-April through August 7. Blankenship v Newsom, n.d., 4:20cv-4479. Here is the Complaint. The case is assigned to U.S. District Court Judge Richard Seeborg, an Obama appointee.

  1. Interesting that Blankenship filed this lawsuit when there are lots of states with much easier requirements where he could be petitioning right now, but is not. Thus far he does not appear to be putting much effort into getting on very many state ballots.

  2. California is the largest state, so focusing here makes sense, but you can’t forget the states he’s not on the ballot. Perhaps he’s working on that too.

  4. The last email I received said that they are working on getting on the ballot in Alaska, Tennessee, and New Jersey. The lawsuit is good to hear though.

  5. There are a lot of states which are harder than those, but easier than Cali. Blankenship isn’t making much of an effort. Instead he is losing some of their few existing ballot lines because the state parties are disaffiliating or putting someone else in instead.

  7. @ Andy – He’s not even bothering to get on the ballot in his own state. Two years ago, he WAS successful in collecting a similar number of signatures on very short notice (thwarted by a kangaroo WV court, but that’s another story), so it is possible here. But clearly he has no interest in actually running for the office. Just having the nomination to boost his ego. That is all. The CP has effectively been duped. Clearly Blankenship is a GOP plant shilling for Trump.

  8. According to what I read online, Blankenship has a personal net worth of $40 million. That is not enough to even come close to winning the White House, but he does have enough money to get on the ballot in a bunch of states without putting too much of a dent in his life style.

    Right now, it is looking like the Constitution Party is going to be on the least state ballots than it has been on for a presidential election year in the history of the party.

  9. I think we can all agree on that. And while it is true he has the money the evidence so far is he’s rather keep it than spend any to speak of.

It’s odd that Blankenship is putting so much effort into getting on the ballot in California, a state where he not only has zero chance of being nominated, but won’t even split the conservative vote to ensure a Biden victory (assuming that’s his intention). It would make more sense for him to get on the ballot in Florida or North Carolina where he could potentially affect the race by drawing disaffected Trump voters.

    Or, it’s possible that he’s actually deluded enough to think he can win, so in that case, California’s EVs will be crucial.
