New York Governor Signs Bill Giving Parties More Control Over Nominations

On October 8, New York Governor Kathy Hochul signed S7191. It makes it easier for parties to prevent non-members from obtaining a nomination. This idea is something the Green Party had long desired.

  1. What does this mean procedurally? Does this get rid of Opportunity To Ballot? Where’s the text?

  2. Not much of a point when the Green Party and other independent third parties can’t even get on the ballot in NY anymore except in local races. The Democrats are taunting us.

    Consistent with this, the OTB petition now says that the signers are seeking to to vote for a party member.

    It is not clear why the Green Party desires this, but they are not noted for their organizational acumen. Perhaps Richard Winger could provide their rationale.

    It would be rare that there would be two Green candidates seeking nomination for any office. If there was only one, the few Green voters (there were only 100 to 200 registered in an Assembly district) would likely vote for them or skip the race. Some Green voters would be surprised that they were registered as Green and had shown up to vote for Trump or some Democrat and handed a ballot and wrote in the name. But that would only apply to top of the ballot races.

    It is as easy to petition for an actual candidate as OTB so it would be rare to have a pure write-in race.

    When Curtis Sliwa led the Reform Party, they would petition for OTB, and invite Blank voters to vote in their primary, effectively making it a non-partisan open primary.

    The bill was initiated when Cuomo was governor, so it is likely some more nefarious intent than being nice to the Green Party. The vote in the Senate was a party-line vote with one Democrat cross over.

    Primary is part of election process. Direct = Indirect in Con Law.
