North Carolina Green Party Files Ballot Access Lawsuit

On July 14, the North Carolina Green Party filed a federal lawsuit to obtain a spot on the 2022 ballot. North Carolina Green Party v North Carolina State Board of Elections, e.d., 4:22cv-78. Here is the 22-page complaint. Even if you don’t normally read legal briefs, considering reading this one. It details the dirty tricks used against the party. The lawsuit challenges the decision of the State Board of Elections to reject the party’s petition, even though the county election boards had already checked the petition and found it had enough valid signatures.

The case is assigned to U.S. District Court Judge James C. Dever III, a Bush Jr. appointee. UPDATE: here is a news story that mentions the lawsuit, but says very little about it.   1. I realize that this is a question about state law and the answer might differ from one state to another. Is it legal for an employee of or volunteer for a political campaign or party to lie on the telephone about the name of the organization they are working for? Can those who sponsored or made these telephone calls be prosecuted? Or is lying in this context considered protected speech?

Oliver Hall was quite successful in helping us win ballot access in Illinois when our state’s Board of Elections, likely at the behest of state/federal Democrats, tried to take advantage of the covid lockdowns (which made the usual petitioning procedure practically impossible instead of just extremely difficult) to prevent any minor party and Independent candidates from getting on the ballot.

    Also, half the battle is won if one’s case is assigned to a fair and unbiased judge. We also had that going for us in IL.
