Fifteen States Submit Amici Brief in Nebraska Case, Arguing that County Distribution Requirements for Initiatives are Constitutional

On July 29, fifteen states filed an amicus in the Eighth Circuit in Eggers v Evnen, 22-2268. The brief, organized by the Arkansas Attorney General, says that county distribution requirements for statewide initiative petitions do not violate “one person, one vote”. The other states that signed the brief are Alabama, Alaska, Florida, Idaho, Indiana, Louisiana, Missouri, Montana, North Dakota, Ohio, Oklahoma, South Carolina, Utah, and West Virginia.

It is odd that the brief is signed by Alabama, Indiana, Louisiana, South Carolina, and West Virginia, because those states don’t even have the initiative process for statewide laws.

The U.S. District Court had enjoined the Nebraska county distribution requirement.

  1. Shocking the amicus brief mentions Moore 1969 –

    one more major chance for the Fed courts to smash the state/local moron hacks —

    esp to get them indicted for their nonstop attempts to overthrow the USA Const., laws and treaties.

  3. Alaska doesn’t even have counties. It’s disappointing to see that Alaska is probably trying to defend it’s own horrible distribution requirement.

  4. The Indiana Attorney General Rokita is doing whatever he can to get conservatives to like him, either to run for Senator in 2024 or Governor in 2024.

  5. Not surprised to see Oklahoma on this list. Since the passage of medical marijuana, the Republicans in the legislature have been trying to get questions on the ballot to make initiatives more difficult. They have proposed nearly everything short of outright banning them. County and Congressional District distributions have been proposed. So have increasing the number of votes needed to pass. I think we have even had a few proposals to increase the total number of signatures. I have not seen a single proposal to make initiatives easier since 2010 when Oklahoma voters approved a question to base all initiative petitions off the last election for Governor.
