D.C. Circuit Sets Hearing Date for Jill Stein’s Appeal on 2016 Primary Matching Funds Repayment

The U.S. Court of Appeals, D.C., will hear Stein v Federal Election Commission, 21-1213, on Wednesday, January 18. The issue is whether Jill Stein, the 2016 Green Party nominee, must repay $175,000 in primary season matching funds. The FEC shifted the rules in 2016. Previously, the primary period ended when the presidential candidate had finished campaigning for the last party nomination in the calendar, which for Stein was her campaign for the Peace & Freedom nomination, which nominated on August 13, 2016. But the FEC changed that rule, and said the primary season ended when she won the Green Party nomination on August 5. Therefore, the money Stein received between August 5 and August 13 could not be matched, and the matching money she received for that period must be repaid, according to the FEC as it applies its newer rule.

  1. It may not be a “law,” but it is an ex post facto regulation, and therefore violates at least the spirit of constitutionality. It also leaves the appearance that the FEC, like the federal court system, hates third parties.

  3. My sources say that the phony truther is an obese Russian Jewish homosexual communist drug addict named Pankel Fraudankel who pretends to be an Italian-American libertarian named Paulie Cannoli. He got caught sabotaging conservative ballot measures in Oregon in 2001 and Republican voter registrations in California in 2003. He is also a former blogger, forum censor and fake news yellow journalist. Using his fake identity he managed to continue working in the paid petition industry and even got elected to the state and national libertarian committees before being exposed by Eric Dondero, Nathan Norman, Andy Jacobs, Ryan Ramsey, and his former Jew Rabbi Robert Milnestein from New Jersey.

    He also played a Nazi character named “Vernon 1488”. He is currently a wanted fugitive, which is why he has stopped using a consistent alias and instead trolls under a multitude of different names now. He is behind the vast majority if not all the trolling here, much of which has been inaccurately blamed on his fellow devil worshiper Robert Stock.

  6. 1.) I find it astounding that Jill Stein raised $175k in 8 days.
    2.) I know I’ve read about this case before here, but isn’t there some kind of statute of limitations for bringing this up? 5 years would put us at August 13, 2021.
    3.) To bring out my Libertarian, why do we have primary season matching funds? If you want to say there should be public funding of candidates for election, I disagree but for the sake of this conversation I won’t touch on that, why do we match the funds of people running for a party’s nomination when the party is a nominally private organization?

  7. Public financing has become an excuse to keep third party and independent candidates off the ballot, allegedly because taxpayer money is “wasted” on “frivolous” candidates.

    While it was supposed to assist less well funded candidates, it has become just another barrier to entry for them.

  8. Public financing should be abolished altogether, and all fundraising caps and limits should be removed.

    Believe me when I tell you that that will do more to support third party and independent candidates than any overly bureaucratic scheme of public financing.

  12. I’m glad that leftist losers like Fraudankel are no longer running the LP. It shows how corrupt they are that they had this disease ridden con artist fugitive felon in party leadership even though he is actually a commie. All leftist losers should be physically removed from the Libertarian and Republican parties. Then when we take power they will be dropped from helicopters or physically removed from the United States. There will also be a death penalty for election or vote fraud and it will be fully retroactive.
