Mother Jones’ Attack on No Labels is Incorrect

David Korn, writing for Mother Jones, asserts that No Labels ought to be revealing its donors. He says that the basis for No Labels’ refusal to disclose its donors so far is because No Labels claims it is not a political party. Korn then mentions that No Labels is a ballot-qualified party in several states.

The real reason No Labels need not reveal its donors so far is because it has never had any candidates. The U.S. Court of Appeals, D.C. Circuit, ruled in Unity ’08 v FEC, 596 F.3d 861 (2010), that a similar group, Unity ’08, need not reveal its donors, even though it was working to qualify for the ballot as a party, because “Unity08’s proposed method of generating nominees was such that neither dnoors nor candidates would know at the time of the donations which candidate would ultimately benefit from the group’s convention.”

  6. Richard, I don’t know if you look at the comments here, given their low quality, but what does it mean to you for the No Labels Party not to have a candidate. You know the ease of winning a newly-qualified political party nomination in Arizona (a plurality of the vote by a write-in candidate, so someone can win the primary with one write-in vote). Does “having a candidate” mean that someone has won the August 2024 No Labels primary for any office? Does it mean that someone has filed to run as a No Labels candidate with the FEC if for a federal office? Does it mean that someone has filed an intention to run statement with the Arizona Secretary of State or handed in petitions for the No Labels August 2024 primary? (Presumably No Labels will not allow a winter presidential preference election [in non-Arizona terms, a presidential primary].)

    I am in the process of recruiting far-right and far-left candidates to run in the No Labels primary, similar to what Steve May did to the Arizona Green Party in 2010. So I can assure you that there will be No Labels Party candidates on the ballot in 2024 even if they choose ultimately not to run candidates for President and Vice President, similar to what happened to Americans Elect in Arizona in 2012 and 2014.

  8. So, I get from the article that until No Labels runs a candidate it doesn’t have to report its donors. That makes sense if it applies to all.
