Final Order Issued in 2022 Green Party North Carolina Ballot Access Case

On August 8, a U.S. District Court Judge issued a final order in North Carolina Green Party v North Carolina State Board of Elections, e.d., 5:22cv-276. This is the case in which the State Board of Elections had refused to put the Green Party on the ballot, even though the county election boards had certified that the party had enough valid signatures. The Judge had put the Green Party on the ballot last year, in time for the election.

The final order summarizes what happened in the case, and says the plaintiffs may seek attorneys fees, but that otherwise the case is over.

The Green Party is on the ballot in North Carolina in 2024 as well. In North Carolina, when a party is on the ballot in a midterm year, it is also automatically on the ballot for the following presidential year. The Green Party will remain on the ballot in North Carolina after 2024 if its presidential nominee appears on the ballot in at least 35 states.

  2. A rare instance where the judiciary branch acted truly independently of the two ruling parties, and made the right decision for free and fair elections and the First Amendment. Wish it happened more often.

  3. Quotas, quotas, quotas, whatever will keep dissenters from the duopoly off the ballot goes. If it smells like fascism it is probably fascist. All ballot access laws that censor voter choice should be abolished and replaced with a write-in only voter verifiable ballot. No quotas, no fees. Voters vote and verify the count is accurate.

  5. Standing count would be better. But the all write in ballot DFR refers to is already standard for overseas voters .

  6. I gotta agree with Joshua on this one. I am sick and tired of the state trying to squash competition and violate others’ first and fourteenth amendment rights. I just wish the State Board of Elections would stop being corrupt. But that’s like telling a person to fly, it’s biologically impossible.

  9. With a few strong third party candidates on the ballot in North Carolina in 2024, NC could become a swing state.

  10. It’s already hotly contested at the state level. Biden is very unpopular, and will be even more so next year, so it probably won’t be a presidential swing state.

  11. If you think the votes were honestly tallied, sure. The percentages were Trump 49.93, Biden 48.59, Jorgensen 0.9, Hawkins 0.2, Blankenship 0.1, write ins 0.2. If you don’t think vote fraud cost Trump even 0.07%, you either haven’t looked at all the evidence of vote fraud or are too biased to look at it seriously. Most Jorgensen voters probably didn’t know she was a Burn Loot Murder supporter; they probably thought she was something like Ron Paul, Rand Paul, Glenn Beck, Neal Boortz etc because they are all described as libertarians and the ballot said she was one. Thus, if the libertarians hadn’t been on the ballot, Trump would have benefited more than Biden.

    2024 will be more Republican leaning because the Biden administration and its policies are ever more increasingly unpopular, and as for Biden himself, his senile dementia is becoming harder and harder to hide even temporarily and in highly staged events. Imagine him debating Trump next year. If the Democrats had anyone better to slide into place to replace him they would have already done it. Hooker Harris is even less popular than Dementia Joe, and passing her over would aggrieve various special interest groups with outsize influence within their D minus Party.

    Between the crappy economy (which his out of touch “brain trust” intends to run on the alleged strength of), the disastrous bottomless money pit of a war in Europe which threatens to spread, the increasingly spreading stench of Beijing Joe and his family’s corruption, the wake of wokism, the mess at the border, and the ever diminishing returns from constantly going after Trump with one false accusation after another, among other things, the Dims have less and less to run on. They now pin their hopes on abortion. Good luck with that, when families have more and more problems paying for things they and their existing kids need, most people know how to prevent conceiving more kids without resorting to abortion, and don’t hold women who lack that responsibleness in high regard.

    Sure, some people just really hate Trump and Republicans. There are even a few weirdos who really think Biden is great (by coincidence, the other day I saw the first Biden bumper sticker I ever recall seeing – I can’t even count how many Trump bumper stickers I see all the time). There won’t be enough of those people to make NC close next year.

  12. Cellar Dwellar Joe won’t get away with hiding in the basement next year like he did in 2020. They can try to whip up hysteria about new covaids variants or a whole new scamdemic, but that too has diminishing returns, and if they go that route it will only make the increasingly available evidence of Dr. Evil Fausci collaboration with commie Chinamen in Wuhan to engineer it and the ham handed cover-up of that an even bigger issue.

    Michael Obama won’t run lest it come out too widely that he has only been pretending to be a woman. Their bench is looking pitiful. They’ll trot out old Joe instead of sending him on an overdue trip to the glue factory only because they have literally nobody who would do better and no real plan B. Things will only get worse for them if he croaks or goes completely comatose in the next 15 months.

  13. Right now it’s looking like Cornell West will be a stronger candidate for the Greens than Hawkins. The libertarians look like they are in more of a disarray nationally compared to 2020, unless they actually conominate Trump. No labels will probably decide against running anyone, but if they do delude themselves into thinking they can win, the Dims are probably right that it will backfire on them and only help Trump. They’ll probably try to withdraw, but still end up getting some votes, mostly at Biden’s expense. To the degree third parties will influence 2024 results, they’ll probably help Trump much more so than in 2020.
