California Will Have Two U.S. Senate Elections in 2024

The California ballot for 2024 will have two U.S. Senate races. Because of the September 29 death of incumbent Dianne Feinstein, whose term was running out anyway, there will be a special election for the period November 2024 through January 3, 2025; and of course the regular election for the term running from January 2025 through January 2031.

Generally when there is an election for a very short term followed by the regular election for the same seat, the same candidates run for both elections, although no one is required to run for both.

California had the same two-race ballot in 2022, and also in 1946. Thanks to Justin Levitt for this news.

  2. Filling short unexpired terms like this is so damn stupid. This is another reason why congress should not meet between election day and the start of the new term (i.e. No “lame duck” session). The only exception would be the rare circumstance of an emergency matter coming up. Then, in that case, the president can call for congress to convene, with confirmation by the senators that were not up for election. If the senate agrees the NEW congress would be seated early.

  3. This total waste of tax money wouldn’t be occurring if the 17th Amendment had never been ratified.

  4. This is another “completely dumb thing” that should be fixed by statute or amendment of “in the event of lame duck terms, the election for the next Congress will suffice”. It would save every state government by there being one less election on the ballot.

Special Senatorial elections to fill vacancies could be expedited if state legislatures modified their election law to permit party caucuses in the legislature to make direct nominations to the special election ballot There would be no need for any primaries, but independent candidates could be nominated directly to the final election ballot by petition.

  7. The 1946 special election was by write-in. William Knowland had been appointed in 1945 after Hiram Johnson died.

    The real problem is that the governor can appoint a temporary senator. If there was no such appointment, California would find a way to hold an election.

    Perhaps there could be a petition with 10% of the total vote in the previous election. If Californians were content with a vacancy then don’t hold a special election.

  9. There was a case like this in New Hampshire a few decades back. (I think it was Norris Cotton’s seat.) Teh Democrat won the special election and the Republican won the regular one.

    One of the papers found a voter who had voted that way and asked why. “Well,” the guy said, “He’s always wanted to be a senator, and how much harm can he do in two months?”

  12. California needs to amend this ridiculous law. A special appointee should fill the rest of an unexpired term if it will be less than 2 years.

    Appointing somebody for 13 months, to then be (possibly) replaced for a mere 2 months, is absolutely insane, and a shameful waste of money.

  13. California should be kicked out of the Union or better yet fall in the ocean.
