New Jersey Lawsuit on Discriminatory Primary Ballot Format Starts to Advance

A lawsuit is currently pending in New Jersey, in federal court, over the state’s discriminatory ballot format in primaries. Candidates backed by the major party organizations enjoy a much more prominent spot on Democratic and Republican primary ballots. The lawsuit was filed in 2020 and has moved slowly. But on December 8, the court said discovery must be completed by July 28, 2024. “Discovery” refers to depositions and interrogatories, which are procedures that witnesses fulfill. 1. In my opinion, the State is not allowed to show any preference among the qualified candidates. Order of names on the ballot based on something material about the candidates is showing preference.

Some states get away with listing the previous winner’s party first, because they can chalk it up to the voters’ preference, not the State’s.

  2. I agree.

Like for example when I applied fo CEO of Disney Corp.

Why shouldn’t me, Mickey Mouse written in crayon with a Florida State Prison postmark, a newsreader produce shipping label fresh off the boat from Venezuela, something from an 8 year old writing a letter to a famous Disney character, last year’s provisional ballot applications for a Kissimmee-Disney Theme Park vacay give a way, Bob Iger, Bob Milnes, a few dead guys, and other so called leading candidates NOT get equal billing ???

That is just SO UNFAIR !!!
