On September 15, two judges of the Tenth Circuit declined to put the Forward Party nominees for statewide office on the ballot. They did not explain why. There is also no explanation for why only two judges, instead of three, participated in the decision. New Mexico Forward Party v Toulouse Oliver, 26-2145. The two judges are Nancy Moritz, an Obama appointee; and Veronica Rossman, a Biden appointee.
The only thing of substance the judges said is that the New Mexico Attorney General’s amicus was not proper for this type of procedure.
It was probably because the party name deadnames the state of New America and inverts the party direction, which is actually backwards and to the left, not forward as they purport.
Given that Obama was born in Kenya and Biden lost his election to Trump, making them both ineligible to hold the office oF POTUS when they did, how can any judges they nominated or decisions those judges made be considered legitimate?

Those dictatorial, tyrannical kangaroos seized that power for themselves starting with the wrongly decided Marbury v Madison in the very early 19th century. They have since played a game of telephone with the constitution, turning its intent on its head multiple times over.

If it weren’t for federal courts striking down severe ballot access laws, we really would have a system in which only Democrats and Republicans could run for office. They’re allowed on the ballot for the time being, at least sometimes, because they almost never win, especially higher level offices, and only infrequently actually change the outcome of major elections if you don’t incorrectly assume that all or almost all their voters would have still shown up, and all or almost all voted the same way, if they were not on the ballot.
For the time being, they mostly act as a safety valve to prevent more voters and potential voters from realizing how little real choice they actually have and how little their votes actually decide.
To the extent that they pose any actual threat to the system, they will disappear from ballots at accelerating rates going forward
