Pennsylvania Township Agrees to Seat Elected Libertarian as Township Auditor, After First Declining to Do So

On January 31, Silver Spring Township officials agreed to swear in Kevin Gaughen as an elected Township Auditor, after having first refused to do so, even though he was elected on November 2, 2021, and no one disputed that he met the qualifications. The election is partisan and Gaughen is a Libertarian.

The township refused to swear him in because it believed that it didn’t need any elected township auditors, because it had hired an accounting firm. But that decision was incorrect, as this Reason story shows. The Reason story ran before the officials decided to accept Gaughen. The Reason story generated enough local publicity to persuade the township to reverse its earlier stance.

U.S. Court of Appeals, D.C. Circuit, Sets Briefing Schedule for Jill Stein’s Lawsuit Over 2016 Primary Season Matching Funds

Last year the Federal Election Commission told Jill Stein, Green Party 2016 presidential nominee, that she must repay $175,272 in 2016 primary season matching funds. The determination said the FEC had overpaid her, because the cutoff should have been when the Green Party nominated her, not the later date when the Peace & Freedom Party of California considered her candidacy but nominated someone else. Stein argues the FEC is using the wrong cut-off date, and she has asked the U.S. Court of Appeals, D.C. circuit, to settle the issue.

The case is Stein v FEC, 21-1213. On January 31, the court said Stein’s brief is due February 14; the FEC brief is due March 16; and the Stein reply brief is due April 6.
